1. Introduction
Visual Works ("we," "our," "us") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what we collect, why we collect it, how we use it, and the rights you have over it.
By using visualworksmd.com (the "Site") or engaging us for services, you agree to the terms of this policy.
2. Information We Collect
We collect only the information needed to respond to inquiries, deliver our services, and operate the Site:
- Contact details you submit via our application or contact forms (name, email, phone number)
- Business information you share with us (business name, industry, project goals, budget)
- Project content you provide (copy, images, logins to third-party services strictly for build access)
- Basic usage data (pages visited, referring source, device type, approximate location) via privacy-respecting analytics
- Payment metadata processed by Stripe — we never see or store full card numbers
We do not collect sensitive personal data, and we do not knowingly collect information from children under 13.
3. How We Use Your Information
We use your information only for legitimate business purposes:
- Responding to inquiries and scheduling discovery calls
- Delivering, supporting, and maintaining the services you've engaged us for
- Processing payments and issuing invoices/receipts
- Improving the Site and our services based on aggregate usage patterns
- Complying with legal, tax, and accounting obligations
We will never send unsolicited marketing, sell your data, or share it with advertisers.
4. Cookies, Analytics & Tracking
We use the following Google services to understand how visitors find and use the Site:
- Google Analytics 4 (GA4) — aggregated traffic, page views, sessions, device/browser type, approximate geographic location (city/region), and referral source. IP addresses are anonymized.
- Google Tag Manager (GTM) — a container used to deploy and manage GA4 and conversion tags on the Site. GTM itself does not collect personal data, but tags it loads (e.g. GA4) do.
- Google Search Console — measures how visualworksmd.com appears in Google Search (impressions, clicks, queries, indexed pages). Search Console data is aggregated by Google and does not identify individual visitors.
These tools set first-party cookies (e.g. _ga, _ga_*) used to distinguish unique visitors and sessions. We do not use Google Ads remarketing, Google Signals, or cross-device advertising features. See our Cookie Policy for the full list and instructions on opting out.
5. Service Providers (Sub-Processors)
We share information only with vendors required to operate our business. Each is bound by contract and/or their own data-processing terms:
- Vercel — Site hosting and edge delivery (United States).
- Stripe — payment processing; PCI-DSS compliant.
- Google LLC — Google Analytics 4, Google Tag Manager, and Google Search Console (analytics and search performance).
- Resend — delivery of contact-form notifications and confirmation emails.
- Our email and CRM providers — to respond to inquiries and manage projects.
6. Data Storage & Security
Form submissions and project records are stored in access-controlled systems hosted in the United States. We retain contact information for up to 12 months after your last interaction with us; project records are retained for up to 7 years to meet accounting and legal requirements.
We use industry-standard safeguards (TLS in transit, encryption at rest, principle of least privilege). No method of transmission or storage is 100% secure, but we work hard to protect your information.
7. Your Rights
Depending on where you live (e.g. California, EU/UK), you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Request deletion of your information
- Object to or restrict certain processing (including analytics)
- Receive a copy of your information in a portable format
- Opt out of the sale or sharing of personal information (we do not sell or share)
To opt out of Google Analytics specifically, install the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout) or block analytics cookies via your browser. To exercise any other right, email info@visualworksmd.com. We respond within 30 days (and typically within 5 business days).
8. Children's Privacy
Our Site and services are not directed to children under 13, and we do not knowingly collect information from them. If you believe a child has provided us with personal information, please contact us and we will delete it.
9. International Visitors
Visual Works is based in Maryland, USA. If you access the Site from outside the United States, your information will be transferred to and processed in the U.S. under U.S. law. Google Analytics data may be processed in the United States and other countries where Google operates.
10. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance.
